The text of the relevant section of the regulation reads:

Misrepresentation
22 Persons who have claimed refugee protection, if disposition of the claim is pending, and protected persons within the meaning of subsection 95(2) of the Act are exempted from the application of paragraph 40(1)(a) of the Act.

Commentary

Section 22 of the Immigration and Refugee Protection Regulations exempts refugee claimants whose refugee claims are pending and those recognized as refugees from being found inadmissible because of misrepresentation under section 40(1) of the IRPA.[1] Which see: Canadian Refugee Procedure/33-43 - Inadmissibility.
