Issue

Would the personnel of state-run enterprises be the public servants under the Criminal Code?

Holding

The personnel of the state-run enterprises with at least half of the stocks owned by the Government shall be considered public servants under the Criminal Code.

Effect

The personnel of the state-run enterprises performs governmental duties, not just businesses.
